1. About Bikes 2 Share

Bikes 2 Share (Pty) Ltd (Reg. No. 2025/848903/07) is a South African private company that rents electric bicycles (e-bikes) to gig economy delivery riders operating in Cape Town and surrounding areas. We operate the website bikes2share.co.za.

2. Eligibility

To apply to rent a bike from us, you must:

• Be 18 years of age or older
• Hold a valid South African identity document or valid permit authorising you to work in South Africa
• Have an active, verified account on at least one supported delivery platform (Buzz Delivery, Uber Eats, Mr D Food, or Bolt Food)
• Be resident in or operating within the Cape Town delivery area

Bikes 2 Share reserves the right to decline any application at our sole discretion without being obliged to provide a reason.

3. The Application Process

Submitting an application form on our website does not constitute a rental agreement. It is an expression of interest. A rental agreement only comes into effect when:

• Your application has been reviewed and verbally approved by a Bikes 2 Share representative
• You have signed the Bikes 2 Share Rental Agreement
• Your security deposit and first week's rental have been received and confirmed by us

4. Rental Fees and Deposit

• Weekly rental fee: R750 per bike, per week, payable in advance
• Security deposit: R1,500 per bike, fully refundable on return of the bike in its rented condition
• First payment: R2,250 (R1,500 deposit + R750 first week's rental) due before collection or delivery of the bike
• Weekly rental payments are due in advance each week and are collected by debit order from your registered bank account
• Missed or failed payments may result in suspension of your rental and recovery of the bike

5. Rider Responsibilities

As a renter, you agree to:

• Use the bike only for lawful delivery activities on supported platforms
• Keep the bike in good working order and return it in the same condition as received
• Charge the batteries safely, on non-combustible surfaces, using only the supplied charger
• Maintain and replace brake pads and tyres at your own cost — these are standard rider consumables
• Report any mechanical fault, accident, damage, or theft to Bikes 2 Share immediately
• Not sublet, lend, or transfer the bike to any other person
• Not modify the bike in any way
• Follow all South African road laws applicable to e-bikes and electric vehicles
• Secure the bike using the lock provided when not in use

6. Bikes 2 Share Responsibilities

We agree to:

• Provide a roadworthy, GPS-tracked, fully charged bike at the time of collection or delivery
• Cover all mechanical and electrical repairs to the motor, battery management system, wiring, and brakes — at no charge to the rider — for faults not caused by the rider's negligence or misuse
• Respond promptly to fault reports and arrange repair or temporary replacement where possible
• Refund the security deposit in full within a reasonable time after the bike is returned in its rented condition

7. Bike Delivery

Bike collection is from our Milnerton depot by default. Delivery to the rider's area is available by pre-arrangement only and must be agreed in advance with a Bikes 2 Share representative. Delivery availability and any applicable conditions will be confirmed during your application process.

8. GPS Tracking

All bikes are fitted with 4G GPS tracking devices that operate continuously during your rental. By entering into a rental agreement you consent to real-time GPS tracking of the bike. This data is used for asset security, theft recovery, and operational purposes as described in our Privacy Policy. GPS tracking data is not used to monitor your personal movements beyond what is necessary for these purposes.

9. Theft and Loss

Where theft occurs and our protocols were followed, liability is assessed fairly and clearly under the terms of your signed Rental Agreement. Full details are provided before you sign — no surprises.

10. Damage

Damage caused by normal wear and use is covered by Bikes 2 Share. Damage caused by negligence, misuse, accident, or violation of the rental terms is the financial responsibility of the rider. The extent of liability for damage is set out in the signed Rental Agreement.

11. Termination of Rental

Either party may terminate the rental with one week's written notice. Bikes 2 Share may terminate a rental immediately and recover the bike without notice in the event of:

• Non-payment of weekly rental for more than 7 days
• Breach of the Rental Agreement or these Terms of Service
• Use of the bike for illegal activities
• Abandonment of the bike
• Subletting or transferring the bike to another person

On termination, all outstanding rental fees become immediately due and the security deposit is applied against any outstanding amounts before refund.

12. Website Use

The content on bikes2share.co.za is provided for general information purposes. We take reasonable care to keep information current and accurate but make no warranty that the website is error-free or uninterrupted. We are not liable for any loss or damage arising from your reliance on website content.

You may not use our website to:

• Submit false or misleading information
• Attempt to gain unauthorised access to our systems
• Post or transmit harmful, defamatory, or unlawful content

13. Limitation of Liability

To the maximum extent permitted by South African law, Bikes 2 Share is not liable for any indirect, incidental, or consequential loss arising from your use of a rented bike, including loss of income due to bike downtime. Our total liability to any rider in respect of any claim is limited to the value of one month's rental fees paid by that rider.

Nothing in these terms limits or excludes our liability for fraud, gross negligence, or any liability that cannot be excluded by law.

14. POPIA and Personal Information

Our collection and use of your personal information is governed by our Privacy Policy, available at bikes2share.co.za/privacy-policy.html and incorporated into these Terms of Service by reference. We process personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA).

15. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising from these terms or your use of our services shall be subject to the jurisdiction of the Western Cape High Court, Cape Town, or such other court as has jurisdiction.

16. Changes to These Terms

We may update these Terms of Service from time to time. Updated terms will be posted on this page with a revised effective date. Your continued use of our website or services after changes are posted constitutes acceptance of the updated terms.
